Important Update: California Revised One of Their Agent Requirements

California Insurance Code requires insurance producers to include their California insurance license number in all printed marketing materials distributed in California

Beginning January 1, 2023, this requirement extends to emails related to activities which require an insurance license.

California resident as well as non-resident insurance producers must include their California insurance license number in emails to recipients in California.

Emails meeting the requirement include but are not necessarily limited to:

  • Emails intended as advertisements
  • Emails which discuss any current or prospective policy
  • Any email discussing rating or underwriting
  • Emails discussing payment of premium.

The rule requires your license number to be displayed prominently either next to or immediately underneath the part of your email which includes your name or title. Your license number must be in a font no smaller than the largest font used in the email for address, email address, or telephone number.

If you own an insurance licensed business entity, or you are contracted with/employed by an insurance licensed business entity, and the business entity’s name appears in the email, the same rules apply for including license number.

Representatives registered with Equity Services, Inc. must have their email signatures approved by National Life Group’s Advertising Guidance Team. ESI representatives that have never had their email signature approved should submit it for approval through their agency using the standard advertising review process.  Be sure to update the CA License number on the signature per the above requirements before submitting it. If the representative’s email signature is already approved, the office can send just the revised signature, noting that it’s only a change to the CA License number on an approved signature.  The office does not need to include NLG’s submission form in this case.  New and revised signature submissions go to the standard intake address – adreview@nationallife.com.

Agents who are not registered with Equity Services, Inc. do not need to obtain NLG’s approval of their email signature as long as it makes no mention of NLG, any NLG company, product or unique product feature. If the signature does mention NLG, an NLG company, product or unique product feature, then for agents in NLG’s Affiliated Distribution channel please follow the same process described in the paragraph above. Agents in NLG’s Independent Distribution channel can submit their signature for review by completing and including NLG’s advertising submission form and a sample of the email signature, and sending it to adreview@nationallife.comThe submission form can be found on NLG’s website under Tools, Compliance, Advertising & Social Media, and can be completed digitally once you download it.
